Violation of 25 CFR § 151.10: “The Secretary, in reviewing the acquisition or sale of trust land, must consider the ‘degree to which the applicant needs assistance in handling his or her affairs.’ The use of a tribal resolution by a 1/8th blood-quantum individual to liquidate the ancestral interests of a 1/2 blood-quantum heir constitutes a ‘Jurisdictional Fraud’ and a failure of the BIA’s fiduciary duty to protect the higher-blood-quantum line of succession.
